1. ORGANIZING COMPANY

The company SEB DEVELOPPEMENT, a simplified joint stock company with a capital of 3,250,000 euros, whose registered office is located at 112, Chemin du Moulin Carron, 69130 Ecully, registered with the Lyon Trade and Companies Registry under number 016 950 842 (hereinafter referred to as the "Organizing Company").

2. PURPOSE AND DURATION

The "Chandeleur Beat the Clock" Instagram contest, free of charge with no purchase necessary, by random drawing, organized from 05/02/2024 at 10:00 AM included (French time) to 09/02/2024, 11:59 PM included (French time) (hereinafter referred to as the "Game").

3. PARTICIPANTS

The Promotion is open to those residents in the UK aged 18 and over. It excludes employees of Tefal UK and anyone professionally connected to the competition. 

Participation in the Game is limited to one entry per person.

4. PARTICIPATION IN THE GAME

Participation in the Game implies the express and unconditional acceptance of these rules in all their stipulations and compliance with all applicable laws and regulations related to games, lotteries, and contests in force in the territories defined in article 2.
Participation in the Game is exclusively on Instagram. Participation by any other means is excluded and will not be considered by the Organizing Company.

To participate in the Game, each Participant must strictly follow these steps in the order indicated:
1/ Be subscribed to the Instagram accounts @GroupeSEB and to the influencer's Instagram account, who publishes the recipe in a cross-post with the Instagram account @GroupeSEB.
2/ Like the recipe
3/ Tag two friends

Each Participant must play in person and is therefore prohibited from using, directly or indirectly, any automated inquiry or request mode of the site. Each Participant will follow the indicated steps to validate their participation.

The Participant certifies that their contact information, if sent to the Organizing Company, is accurate. Participants are informed that the information requested during the Game is necessary to take into account their participation and the awarding of prizes. Participants are therefore invited to ensure the validity of this information. Any false declaration or erroneous and/or incomplete declaration will automatically result in the cancellation of entries and non-award of prizes, which will not be put back into play and will remain the full and entire property of the Organizing Company.

5. PRIZE AWARDING

Winners will be designated by a random drawing conducted on 09/02/2024.
Only one prize will be awarded per household (same name, same postal address) throughout the duration of the Game, the household being determined by all the people living under the same roof (same name, same postal address).

Winners will be informed of their prize and the delivery terms of their prize by private message on Instagram, within 10 days from the end date of the Game. Winners will receive their prizes by mail within approximately 6 to 8 weeks following the end of the Game after verification of the conformity of their participation.

Any prize returned to the Organizing Company by mail or by the transport service provider, for whatever reason (e.g., no longer living at the indicated address), will be considered abandoned by the winner and will not be put back into play by the Organizing Company. The Organizing Company will not be required to conduct additional searches. Any unclaimed prize within three (3) months after the closing date of the Game will be considered abandoned by the winner(s) and will not be put back into play by the Organizing Company; it will remain the full and entire property of the Organizing Company.

Consequently, the Organizing Company cannot be held responsible:

In case the identity and/or address of the winner is incorrect;
In case of return of a letter/package if the postal coordinates or the identity do not correspond to those of the winner, are incorrect, or if the winner remains unavailable;
In case of routing errors, losses, damages, delays, and/or thefts of prizes by the postal services or any other similar carrier.
It will not be required to conduct additional searches. The winner will not receive their prize nor any compensation or indemnity.

6. PRIZES

The following are up for grabs:

• 1 Heart-shared frying pan Tefal X Bonne Maman , reference 2100131044, with an indicative value of €23.49 including VAT
• 1 Crep’party Tefal X Bonne Maman , reference 2100129820, with an indicative value of €39.99 VAT
• 1 Spoon set + blade spatulaTefal X Bonne Maman, reference 2100128258, with an indicative value of 4.11€ VAT

Together referred to as the "Prize".

The Prize offered is strictly personal and therefore cannot be transferred to another person. In the event that the Winner does not wish or is unable to take advantage of all or part of the won Prize, under the conditions described in these rules, they will lose the full benefit of said Prize and cannot claim any compensation or consideration. The Prize will not be put back into play and the Organizing Company may dispose of it freely.

Prizes cannot be returned at the winners' request for their cash value nor be replaced by other prizes. The Organizing Company reserves the right to replace the Prize with a prize of equal value if circumstances require it and will inform Participants by all means.

7. LIABILITY

Participation in the Game via the Internet implies knowledge and acceptance of the characteristics and limits of the Internet and related technologies, particularly concerning technical performance, response times to consult, query or transfer information, the risks of interruption, and more generally, the inherent risks of any connection and transmission, the lack of protection of certain data against possible misappropriation, and the risks of contamination by any viruses circulating on the network. It is expressly reminded that the Internet is not a secure network.
The Organizing Company specifies that the use of hyperlinks can lead the Participant to other websites, independent of the Organizing Company. In this case, the Organizing Company cannot assume responsibility for the activities of third-party sites.

Unless expressly agreed upon, no Participant is authorized to create a hyperlink between the site and another website, at the risk of incurring liability.

The Organizing Company cannot be held responsible for the malfunctioning of the site(s) and/or the Game for a given browser.

The Organizing Company does not guarantee that the sites and/or the Game will operate without interruption or do not contain any computer errors. In case of technical malfunction of the Game, the Organizing Company reserves the right, if necessary, to invalidate and/or cancel the Game Session during which said malfunction occurred. No claim will be accepted as a result.

The Organizing Company cannot be held responsible if the data relating to a Participant's registration did not reach it for any reason for which it could not be held responsible (for example, an internet connection problem due to any reason at the user's end, a temporary failure of our servers for any reason, etc.) or would arrive unreadable or impossible to process (for example, if the Participant has computer equipment or an inappropriate software environment for their registration, etc.).

The liability of the Organizing Company is limited to the total maximum amount of the prize(s) offered in the Game. The Organizing Company cannot be held responsible for any kind of damage (personal, physical, material, financial or other) that occurs during a Participant's participation in the Game. The liability of the Organizing Company cannot be incurred, without this list being exhaustive:

If a Participant is accidentally disconnected by the telephone operator or their internet service provider;
If a Participant forgets to enter their contact details;
If a Participant experiences any kind of technical breakdown (example: poor condition of the line, of the handset);
If a technical failure of the telematic server or the telephone post of the switchboard prevented a Participant from accessing the registration form;
In case of a power outage or server incident;

of the transmission and/or reception of any data and/or information on the Internet;
of any malfunction of the Internet network preventing the proper conduct/functioning of the Game;
of failure of any reception equipment or communication lines;
of loss of any email not due to its action;
of routing problems;
of the operation of any software;
of the consequences of any virus, computer bug, anomaly, technical failure;
of any damage caused to a Participant's computer;
of any technical, material and software failure of any kind, which prevented or limited the possibility to participate in the Game or damaged a Participant's system.
It is specified that the Organizing Company cannot be held responsible for any direct or indirect damage resulting from an interruption, any malfunction whatsoever, a suspension or the end of the Game, for a reason that would not be attributable to it, or for any direct or indirect damage that would result, in any way, from a connection to the Game's website.

It is up to each Participant to take all appropriate measures to protect their own data and/or software stored on their computer equipment against any attack.

The connection of any person to the Game is done under the full responsibility of the Participant.

It is agreed that the Organizing Company may avail itself, in particular for evidentiary purposes, of any act, fact or omission, programs, data, files, records, operations and other elements (such as follow-up reports or other statements) of a computer or electronic nature or format or support, established, received or kept directly or indirectly by the Organizing Company, in particular in its information systems, in connection with the use of its website.

8. INTELLECTUAL PROPERTY

In accordance with the laws governing intellectual property rights, the reproduction and representation of any or all elements composing the Game are strictly prohibited.

9. CONTENT - MODERATION

The Participant undertakes to comply with all applicable laws and regulations concerning the prohibition of the dissemination of pornographic, pedophilic, violent, obscene content, or of a nature to seriously harm human dignity.
Furthermore, the Participant is prohibited from disseminating any message intended to promote a product or service.

To this end, the Participants acknowledge that the Organizing Company may remove any manifestly illegal content. In particular, messages and photos that could constitute incitement to commit crimes or offenses, discrimination, hatred or violence because of race, ethnicity or nationality, advocacy of Nazism, disputes over the existence of crimes against humanity, infringement of the authority of justice, defamation and insult, infringement of privacy, or acts endangering minors, as well as any file intended to exhibit objects and/or works prohibited, messages of a defamatory, coarse, insulting, violent nature or contrary to the laws in force, messages about tobacco and alcohol, messages containing personal details and information allowing precise geographical localization (telephone, postal address...), messages inciting the consumption of prohibited substances or suicide, messages allowing third parties to directly or indirectly obtain pirated software, serial numbers of software, software allowing acts of hacking and intrusion into computer and telecommunication systems, viruses and other logical bombs and in general any tool or software or other, messages allowing to infringe the rights of others and the safety of persons and property in violation of the private nature of correspondence.

The Participant releases Instagram from any responsibility related to the Game. The promotion linked to the Game is not managed or sponsored by Instagram.

10. PROTECTION OF PERSONAL DATA SEB DEVELOPPEMENT

("the Group") attaches great importance to the protection of your privacy. In the context of this offer, we process information that may concern you directly or indirectly ("personal data") for the following purposes: Purposes Legal Basis Allow you to participate in the game and/or communicate with you about it The processing is necessary for the performance of a contract to which you are a party or for the performance of pre-contractual measures taken at your request Send you communications about our products and services, according to your preferences The processing is based on your consent Collecting your data is a contractual prerequisite necessary to allow you to participate in the Game. When they are not located in your country of residence, the recipients mentioned above are generally located in the European Economic Area and/or in countries that offer an adequate level of protection of personal data.

However, in some cases, personal data may be transferred to a country that does not provide a sufficient level of privacy protection. Your personal data will be kept for three years after the end of the operation, or, if you have consented, for the duration during which you continue to accept to receive our marketing communications.

In certain circumstances, we may anonymize your personal data (so that they can no longer be directly or indirectly associated with you) for research or statistical purposes, in which case we are allowed to use this information indefinitely without informing you.

You have the following rights regarding the processing of your personal data: right of access, right to rectification, right to erasure, right to object, right to restriction, right to portability, the right to withdraw your consent.

You also have the right to set out directives concerning the conservation, erasure and communication of your personal data after your death.

11. DISPUTES

Participation in this Game implies unconditional acceptance of these rules.

Any contentious interpretation of these rules and all cases not provided for will be decided by the Organizing Company. Any request regarding the interpretation of the rules must be sent in writing. No request regarding the interpretation of these rules received by the Organizing Company more than 30 days after the end of the Game will be answered.

In case of dispute, it is possible to resort to conventional mediation or any other alternative dispute resolution method.

Any litigation will fall under the competent jurisdiction of LYON. This Game is subject to French law.
